Event: Trade mark litigation in the Federal Court

The Federal Court of Australia, in collaboration with IPSANZ, invites members and non-members of IPSANZ to the upcoming event, 'Trade Mark Litigation in the Federal Court', a presentation and panel discussion hosted by Justice Burley, Justice Rofe, Judicial Registrar Luxton, Judicial Registrar O’Connor and members of the profession.

The first segment of this event will be held at the Melbourne registry of the Federal Court of Australia from 5:30pm AEST on 30 July 2025, and will be livestreamed to the Adelaide (at 5:00pm ACST) and Perth (at 3:30pm AWST) registries.

The second segment will be held at the Sydney registry of the Federal Court of Australia from 5:30pm AEST on 18 August 2025, and will be livestreamed to the Brisbane registry.

Judges from Adelaide (Justice Charlesworth and Justice O’Sullivan), Perth (Justice Jackson) and Brisbane (Justice R Derrington and Justice Downes) will host the livestream in their respective registries.

Members of the profession are welcome to attend in-person at their local registry or watch the seminars virtually.

TOPIC IN BRIEF:

The event will feature presentations:

  • in Melbourne from Lucy Davis, Tim Burn-Francis and Amy Surkis on recent relevant topics in trade mark litigation, including deceptive similarity with a focus on shape and other non-traditional marks, the good faith defence to infringement and the intersection of ss 44(3), 58 and 60 of the Trade Marks Act 1995 (Cth); and
  • in Sydney from Meg Evetts and Sam Hallahan on recent developments in trade mark litigation, including deceptive similarity with a focus on reputation, shape and other non-traditional marks, and defences to infringement, including good faith use of own name.

Each event will conclude with a panel discussion with Justice Burley and Justice Rofe on reform proposals for the conduct of trade mark cases in the Federal Court.

Following each session, attendees are invited to stay for informal discussions over drinks and canapés.
