Review of Digital Practices and Procedures

1 August 2025

The Federal Court of Australia is conducting a review of its digital practices and procedures. This will  include a review of all relevant practice notes including the current Technology and the Court  Practice Note (GPN-TECH), relevant guidelines and any necessary rule changes.

The middle of 2025 provides a useful juncture at which to take stock of where the Court has landed  on digital practice following the COVID-19 pandemic. The Court has decided to conduct a review of its  digital practices to see what is working well, what is not and what changes need to be made.

The Court seeks submissions from interested parties on the following matters:

  • Virtual hearings
  • Live streaming
  • Digital court books
  • Concurrent expert evidence conducted by virtual hearings
  • Any other topic relating to digital practice which is of concern to you.

The Court would also like to receive submissions on the uses of artificial intelligence in litigation in the  Court including the potential need for any regulation. It is also interested to receive submissions on  whether this is a topic which needs to be addressed uniformly across all Courts.

Submissions

Submissions should be limited to no more than 10 pages and should be received by close of business  by Friday 26 September 2025. Submissions should be submitted in PDF format addressed to Mr  Michael Serban at michael.serban@fedcourt.gov.au.
