Adverse Action List

The Federal Court and the Federal Circuit Court will be piloting a joint “Adverse Action List”, conducted fortnightly, commencing in Melbourne on 3 July 2019 at 9:30am. Subject to some exceptions (eg proceedings commenced by Regulators and Registered Organisations or proceedings seeking injunctive relief), the first Case Management Hearings in General Protections Matters under the Fair Work Act 2009 will be included in the list. The purpose of the list is to:

  • promote consistency and efficiency in the case management of Adverse Action matters;
  • ensure that proceedings are heard in the appropriate Court in consideration of any points of principle and the quantum of claims; and
  • ensure that the resources of the Court in relation to mediation are targeted towards the most appropriate matters.
