This Practice Note is REVOKED

On 25 October 2016, as part of the National Court Framework reforms, all existing practice documents were revoked and new national practice notes were issued, effective immediately.

To assist Court users to understand these practice note changes, the Court has prepared:

Service of documents outside of Australia

1.  A party applying for leave to serve originating process or other court documents on a person in a country other than Australia under Division 10.4 of the Federal Court Rules 2011 should support the application with evidence of information obtained from the Private International Law Section of the Commonwealth Attorney-General’s Department in relation to the appropriate method of transmitting documents for service in that country, including whether documents:

(a)  should be transmitted in accordance with an international agreement or arrangement, and the details of that agreement or arrangement;

(b)  should be transmitted for service via the diplomatic channel; or

(c)  may be transmitted for service by a private agent within the territory of that country.
