The table below outlines in summary form the changes to the Court's practice documents since 16 February 2015. Refer to the Practice Notes for a full list of the current practice notes. Refer to the Revoked Practice Documents for a full list of the Court's revoked practice notes.

Note: all Administrative Notices were revoked on 25 October 2016. Administrative Notices will no longer be used by the Federal Court.

The Federal Court revoked the version of the Cross-Border Insolvency Practice Note: Cooperation with Foreign Courts or Foreign Representatives (GPN-XBDR) issued on 25 October 2016 and issued the new Cross-Border Insolvency Practice Note: Cooperation with Foreign Courts or Foreign Representatives (GPN-XBDR) effective immediately.

The Federal Court issued 8 revised practice notes.

The majority of the changes concern the wider adoption of the Concise Statement Method into other NPAs of the Court, following its success in the Commercial and Corporations NPA where it was first introduced.

In addition to the Commercial & Corporations Practice Note (C&C-1), the Concise Statement Method is now found in the Central Practice Note (CPN-1) and referred to in the following practice notes: Administrative and Constitutional and Human Rights (ACLHR-1), Admiralty and Maritime (A&M-1), Employment and Industrial Relations (E&IR-1) and Intellectual Property (IP-1).

The main changes to the other practice notes include:

  • Class Actions General Practice Note (GPN-CA):
    • The replacement of the 'docket judge' and 'case management judge' concepts with the 'class actions management judge'
    • Additional matters the parties should be ready to address at the first case management hearing
    • The obligations of the parties where they become aware of a competing class action; and
    • The duties and expectations imposed upon the applicant's solicitor in seeking the Court's approval to a settlement.
  • Employment and Industrial Relations (E&IR-1):
    • the use of concise statements
    • additional matters the parties should be ready to address at the first case management hearing; and
    • dealing with evidence before the first case management hearing

The Federal Court issued a new practice note, Defamation Practice Note (Def-1), effective immediately, following consultation with the profession. Defamation is a Sub area within the Court's Other Federal Jurisdiction National Practice Area.

The Federal Court revoked the version of the Interest on Judgments Practice Note (GPN-INT) issued on 25 October 2016 and issued the new Interest on Judgments Practice Note (GPN-INT) effective immediately.

The Federal Court issued the NPA practice note - Federal Crime and Related Proceedings (CRIME-1) effective immediately.

On an interim basis, as part of the National Court Framework, the NCF 1 – National Court Framework and case management practice note was issued. It applied to the Commercial and Corporations NPA only.

This Practice Note sets out the fundamental principles concerning the national framework of the Federal Court, together with key principles of case management procedure. All other Practice Notes and Administrative Notices are to be read within the framework established in this Practice Note.
