EXPENDITURE ON CONSULTANTS

The Court’s policy on the selection and engagement of all contractors is based on the Australian Government’s procurement policy framework as expressed in the Commonwealth Procurement Guidelines (January 2005) and associated guidance documentation published by the Department of Finance and Administration.

Where the total value of a particular consultancy contract exceeds the Australian Government’s Procurement Threshold for Covered Procurement, the Court’s selection and engagement procedures are based on the Mandatory Procurement Procedures specified at Division 2 of the Commonwealth Procurement Guidelines. During 2004-05, there were no consultancy contracts let with a value exceeding the Procurement Threshold for Covered Procurement.

The Court’s procedures for selection and engagement of a consultant where the total value is below the Procurement Threshold are based on the key principle of value for money and the requirements of Division 1 of the Commonwealth Procurement Guidelines.

The main purposes for which consultants were engaged focused on the delivery of specialist and expert services primarily in connection with the Court’s information technology infrastructure, finance and business elements of the Court’s corporate services delivery, and selected building and courtroom infrastructure facilities. Table 1 below lists all consultancy contracts let during 2004-05 to the value of $10,000 or more, including GST, and provides details for each individual consultancy.

(1) Selection Process

The selection and engagement of the consultant is based on:

(a) A direct approach to a single supplier known to have the requisite skills or having previously undertaken closely related work for the Federal Court of Australia, and the value of the services did not justify the expense or delay associated with a competitive process.

(b) An appropriately competitive process of a scale commensurate with the size and risk profile of the particular consultancy.

(2) Justification

Justification for engaging consultancy services is based on:

(A) A requirement for specialist expertise not available within the Federal Court of Australia.

(B) A requirement for an independent assessment.

Competitive Tendering and Contracting

During 2004-05, there were no contracts let to other organisations for the delivery of services previously performed by the Federal Court of Australia.

Exempt Contracts

During 2004-05, there were no contracts or standing offers exempt by the Chief Executive from publication in the contract reporting section on AusTender (formerly known as the Gazette Publishing System).
