Upcoming eLodgment changes for Bankruptcy Creditors Petitions and Corporations Winding Up applications

4 October 2017

9 October 2017

The expected changes to eLodgment were not introduced over the weekend 7 & 8 October due to a technical issue. Our IT team is working with the vendor to isolate the issue. We will follow up with more communication around the expected timeframe of when this issue will be fixed.

Bankruptcy Creditors Petitions and Corporations Winding Up Applications will continue to be reviewed and processed by the registry staff until this issue is resolved.

Thank you for your patience.

Automatic acceptance of Bankruptcy Creditors Petitions and Corporations Winding Up Applications will be reintroduced on Saturday 7 October 2017. This means, for these applications, you can select a convenient listing date and time for attending Court.

This affects:

Federal Court of Australia forms:
Creditors petition: Federal Court (Bankruptcy) Rules 2016 Form B6
Corporations Action with the Case Type Winding Up: Originating process: Federal Court (Corporations) Rules 2000 Form 2

Federal Circuit Court forms:
FCC Creditors petition: Federal Circuit Court (Bankruptcy) Rules 2016 Form B6

Applications and supporting documents for these matters will be automatically accepted and you will receive your stamped service copies straight away. You will not need to wait for the registry to process them.

Note:

You will need to finish all incomplete lodgements before 7 October. Your templates will be deleted and you will need to recreate them after this upgrade.

For lodgements after 7 October, you should have your Court diary available to assist selecting convenient dates and times. Be sure to spell and sequence the party names correctly as you will be asked to accept an automatically generated file title. The file title will appear on your stamped documents and cannot be changed except by an order of the Court.

More information about this change is available on the Court’s website. If you require assistance, please email elodgment_admin@fedcourt.gov.au.
