Biennial Fee Changes from 1 July 2018
The Federal Court and Federal Circuit Court Regulation 2012 (the Regulation) prescribe court fees for proceedings in the Federal Court of Australia (FCA) and in general federal law matters in the Federal Circuit Court of Australia (FCC).
Section 2.20 of the Regulation currently provides for a biennial indexation in the fees mentioned in Schedule 1 of the Regulation (except in relation to items 102 to 104, 107, 124, 202, 209, 210 and 220). This increase is due to next take effect on 1 July 2018.
In the 2018 Federal Budget, the Government announced that most general federal law fees in the Federal Court and the Federal Circuit Court would be increased by a further 3.9 percent in addition to the indexation increase under section 2.20 of the Regulation, and that the indexation fee increases would take place annually, instead of biannually, following the increase on 1 July 2018.
To give effect to both the biennial and additional increases and to change indexation to annual, amending regulations, the Court and Tribunal Legislation Amendment (Fees and Juror Remuneration) Regulations 2018, were registered on the Federal Register of Legislation on 21 June 2018. The increased fees apply to any document filed or any service requested on or after 1 July 2018.
A table of fees payable in the Federal Court will be available on the Federal Court website after 1 July 2018.
