Forms and guides

Follow these steps to access native title forms and guides to help you complete the most commonly used forms.

1. Identify the form you require from the table below (for example, Form 1).
2. Click on the name of the form (for example, Native Title Determination Application). This link takes you to a new page from where you can download the form and a guide to help you fill it out.
3. You can then fill out, save and print the form or guide on your own computer.

Modified forms are ready to fill out. These include a document header and footer as required by Order 41 of the Federal Court Rules. Using the modified form will help ensure that your form complies with the Federal Court Rules.

Prescribed forms are displayed exactly as they appear in the First Schedule of the Federal Court Rules. They do not include a document header or footer.

A filing fee applies to some native title forms. If you cannot afford this fee you can ask the Court to waive it. Some people are also exempt from paying fees (for example, if you have been granted Legal Aid or are the holder of a health care card). A form to ask the Court to waive or grant an exemption from the fee is available on this website.

Form Use
Form 1: Native Title Determination Application (Claimant Application) For Aboriginal or Torres Strait Islander people who assert that they hold native title in respect of land and/or waters.
Form 2: Native Title Determination Application (Non-claimant Application) For people who hold non-native title interests who wish the Court to determine whether native title rights exist over an area of land and/or waters.
Form 3: Revised Native Title Determination Application. For people who believe they have evidence which requires a native title determination to be revised
Form 4: Native Title Determination Application (Compensation Application) For Aboriginal or Torres Strait Islander people seeking compensation for the loss or impairment of native title rights or interests
Form 5 Notice of intention to become a party to an application
