Appeals

This section contains specific information about how to appeal under the Federal Court Act 1976 from:

  • a decision of a single Judge of the Federal Court whether interlocutory or final;
  • a decision of a Supreme Court of a Territory other than the Australian Capital Territory or Northern Territory;
  • a decision of a court (other than a Full Court of the Supreme Court) of a State, the Australian Capital Territory or the Northern Territory, exercising federal jurisdiction;
  • a decision of the Federal Magistrates Court.

It does not cover:

  • applications for orders of review under the Administrative Decisions (Judicial Review) Act 1977;
  • appeals from decisions of the Administrative Appeals Tribunal or other tribunals;
  • appeals from decisions of the Registrar of Patents, Registrar of Designs or Registrar of Trademarks.
