No. 13. Service of documents outside Australia

Practice Note No 13 issued on 28 April 1997 is revoked and the following Practice Note is substituted.

A party applying for leave to serve originating process or other court documents on a person in a country other than Australia under Order 8 of the Federal Court Rules should support the application with evidence of information obtained from the Private International Law Section of the Commonwealth Attorney-General’s Department in relation to the appropriate method of transmitting documents for service in that country, including whether documents:

(a) should be transmitted in accordance with an international agreement or arrangement, and the details of that agreement or arrangement;

(b) should be transmitted for service via the diplomatic channel; or

(c) may be transmitted for service by a private agent within the territory of that country.
