Jury Service: Attendance Fees and Travel Allowance

This information sheet sets out the relevant fees for people summonsed to attend court for jury selection; fees for people selected to a jury; and instructions for applying for reimbursement of reasonable travel costs.

Attendance fees for people summonsed to attend court for jury selection

A person who attends court in response to a summons for jury service may be entitled to an attendance fee.

The rate of attendance fee is set under the Federal Court and Federal Circuit Court Regulation 2012. Under section 3.04 of the Regulation, the prescribed fees are increased every two years for changes in the Consumer Price Index (CPI). This last occurred with effect from 1 July 2016. A copy of Schedule 2 to the Regulation, which sets out the current fees, is attached.

The current rate* for attending court on the first day of a trial is $54.50, if the person attends court for four hours or less; or $109 if the person attends court for more than four hours. If a potential juror is required to attend court on more than one day, the daily rate* is $109 for days two to five; $119 for days six to 10; and $132 for any day after that.

A potential juror who attends court will be asked to provide bank account details so the appropriate attendance fee can be paid by electronic funds transfer.

 

Fees payable for people selected to a jury

A person who is selected on a jury will be entitled to a fee for every day they are required to attend court.

The rate of jury fees is set under the Federal Court and Federal Circuit Court Regulation 2012. Under section 3.04 of the Regulation, the prescribed fees are increased every two years for changes in the CPI. This last occurred with effect from 1 July 2016. A copy of Schedule 2 to the Regulation, which sets out the current rate of jury fees, is attached.

The current rate* of jury fees for the first day of a trial is $54.50, if a juror attends court for four hours or less; or $109 if the juror attends court for more than four hours.

The daily rate* is $109 for days two to five; $119 for days six to 10; and $132 for any day after that, with an additional amount payable of the jury sits for more than eight hours on the last day of the trial.

A person who is selected on a jury will be asked to provide bank account details so that jury fees can be paid by electronic funds transfer.

 Travel allowance for jurors and potential jurors

A juror or potential juror who is required to travel more than 30km (by the shortest practical route) from his or her usual place of residence to the Federal Court, can apply to the Sheriff for reimbursement of reasonable travel costs.

On the first day of the trial, a Sheriff’s officer will ask the people who have attended court if any of them want to claim travel allowance. The officer will provide a claim form to any person who wants to claim travel allowance.

* These rates are increased automatically every two years for changes in the CPI. The next automatic increase will be from 1 July 2018. In addition, they are reviewed from time to time. As a result they may be higher by the time a matter comes to trial.
