Forms, filing, fees and costs

Filing

Documents may be filed (lodged) at the Court either in person or by post or fax or by the Court's electronic filing facility. Filing fees may be charged for filing some forms or documents. Filing fees may be exempted or waived in certain circumstances.

Most applications and other documents used in the Federal Court must be set out in accordance with the forms in the Federal Court Rules, the Federal Court (Corporations) Rules 2000, the Native Title (Federal Court) Regulations and the Admiralty Rules.

To find the appropriate form use 'alphabetical index to forms'. To download a form and get a guide to filling it out, use 'all forms for downloading (in numerical order)'. To download forms for exemption or waiver of fees, use 'exemption and waiver of fees'.

Fees and costs

The Federal Government imposes filing fees, setting down fees and hearing fees for an application or appeal filed in the Court. These Court fees are different from the fees that lawyers charge their clients.

Parties may employ lawyers (barristers or solicitors) to represent them in a proceeding. These lawyers usually charge their clients for their services (fees) and expenses that they have paid on the client’s behalf (disbursements). Disbursements may include court fees. Together these charges are known as costs.
